What Federal Judge Holds the Record for Highest Percentage of Cases Overturned By Scotus?

looneyThis federal judge had six cases heard by the US Supreme Court, with four of them being overturned.  It should be noted here that the votes were not along party lines with one case being unanimous and another at 7-2.

This judge said in 2005 at a symposium at Duke University the court is where policy is made.  (Funny, I thought judges were supposed to interpret law, not make it).  So, who is this judge?  Sonia Sotomayor of the current Supreme Court.

Let’s review the cases where she was overturned:

2008:  Ruled that the city of New Haven Connecticut could throw out results of promotion tests for the sole reason that not enough minorities passed the test.  The test itself was not questioned on its fairness and it was conceded that the test was not racist or discriminatory.

Will this presidential election be the most important in American history?

Her decision was overturned in July of 2009.  The Senate confirmed her appointment just one month later. 5-4
