Judge Delays Jack Smith’s Prosecution Of President Trump

It looks more and more likely that special prosecutor Jack Smith, who is chasing President Donald Trump with a list of charges stemming from his comments on the 2020 election that include obstruction and conspiracy, won’t get his way with the case.

Smith has been insistent throughout the court proceedings to date that the case remain on the docket, on schedule, for no other reason that is apparent than he would like a “conviction” of Trump before the presidential election in November.

Now that’s looking dim.

Fox News confirmed on Friday that the trial has been delayed indefinitely.

It was scheduled for March 4, just one day before the Super Tuesday primaries in Colorado, Alabama, Alaska, American Samoa, Arkansas, California, Maine, Minnesota, Massachusetts, Oklahoma, North Carolina, Tennessee, Texas, Utah, Virginia and Vermont.

The politics of the case appeared when that specific date was chosen, because it would mean President Trump would be with his lawyers, preparing for court, in the runup to those significant votes instead of reaching out to Americans to support him.

Judge Tanya Chutkan, who previously publicly has made disparaging remarks about President Trump, on Friday vacated the date, confirming there will be a new date “if and when the mandate is returned.”

Trump has argued he has immunity for his comments while president, and while Chutkan refused to recognize that, the arguments now are before an appellate court. It’s likely then that the Supreme Court could take it up, too.

Smith had demanded that the Supreme Court hear those arguments immediately and rule right away, but the justices declined to go along with his political timetable.

Chutkan earlier had paused filings and proceedings, because of the pending appeal, and when Smith continued to file arguments anyway, Trump’s lawyers asked that he be held in contempt. The judge would not do that, but made it clear that Smith would only be allowed to make further filings with her permission.

Lawyers for Trump had asked Chutkan to pause proceedings against Trump in the Jan. 6 case while his appeal is pending.
