DOJ Says it will Stand with Court Ruling that Obamacare is Unconstitutional

In the last week, numerous pieces of good news have Republicans on a winning streak. Democrats not so much. Fox reports that on March 25, the DOJ stated they will stand with the Texas court ruling from last year that stated Obamacare is unconstitutional. Democrats are throwing a tantrum. Understandable, since they’ve had a rough week.

Must be awful to be a Democrat in all of this winning.

Judge Reed O’Connor ruled in December that the entire Obamacare legislation is unconstitutional because the “tax” part of the law which created the penalty for not having insurance was removed. With the individual mandate gone, the rest of the law should not stand. The DOJ has issued a statement that they will file a brief in agreement with that ruling on appeal.

Will this presidential election be the most important in American history?

Immediately as the news broke last night, Democrats panicked as their signature healthcare law came into serious question. Some of the 2020 Democrats such as Kamala Harris and Bernie Sanders, are advocating “Medicare for all” – a single payer medical system that would eliminate private insurers entirely.

Eleven Million people signed up for Obamacare for the 2019 year. The pressure is now on the backs of Congress to move forward with a better law. Pre-existing condition protection is one of the main sticking points, and the Trump administration has long argued that at least that part of the ACA should be removed. Now they have agreed that the entire law should be invalidated.

Extracting people from dependence on the government will always be a messy situation. Obamacare premiums rose almost exponentially during the years – it became extremely difficult for some of us to pay for them. We paid for pregnancy care for everyone even if they didn’t need it. We paid for pre-existing conditions on everyone even if they didn’t have any. Congress is now charged with the necessity to come up with a decent medical bill that is flexible.

In this current partisan environment, it appears that Democrats would rather point their fingers at Trump instead of doing the right thing.
