The ATF has proposed a new rule for citizens that threatens to stop private gun sales unless the seller registers as a firearms dealer and receives an FFL. It does NOT require every single seller of used firearms to obtain an FFL, but it does set the stage to cause serious issues for law-abiding citizens. The White House is touting the new rule as necessary to stop “illicit firearms transactions,” but pro-gun advocates are sounding the alarm.
“An increasing number of individuals engaged in the business of selling firearms for profit have chosen not to register as federal firearms licensees, as required by law. Instead, they have sought to make money through the off-book, illicit sale of firearms. These activities undermine the law, endanger public safety, create significant burdens on law enforcement, and are unfair to the many licensed dealers who make considerable efforts to follow the law.
“The Gun Control Act’s exceptions to the license requirement exist to allow all law-abiding Americans to exercise their Second Amendment rights—not to facilitate the intentional evasion of the background-check system. This new proposed rule would clarify the circumstances in which a person is ‘engaged in the business’ of dealing in firearms, and thus required to obtain a license and follow the laws Congress has established for firearms dealers.” (ATF) Director Steven Dettelbach.
The Biden Administration is trying to seem “reasonable” when we know they are not reasonable in any way, shape, or form. They hate guns and are pursuing their anti-gun agenda at every turn. They have already revoked hundreds of Federal Firearms Licenses over tiny clerical errors. Instead of going after real criminals, they are creating new ones.
This new administrative rule seeks to take advantage of a change in last year’s Bipartisan Safer Communities Act. The Act altered the criteria for those considered to be “engaged in the business” of dealing firearms, making it easier to require federal licensing. Attorney General Merrick Garland stated that the new rule is designed to enact the Congressional intent to broaden background checks, which aim to prevent firearms from reaching dangerous hands.
“This proposed rule implements Congress’s mandate to expand the definition of who must obtain a license and conduct a background check before selling firearms.”

If true, why didn’t Congress just change the language in the Bipartisan Safer Communities Act? … Should the proposal be successfully implemented, it could substantially increase the number of people needing a federal license to sell used firearms. “Congressional intent” – Having the politically charged DOJ interpret the law is a bad idea. The agendas of the Biden administration are allowing unelected bureaucrats the ability to squeeze the life out of the Bill of Rights by using rule changes and interpretation of laws that may not be legally correct. Biden does not have the full backing of Congress to jam through a ban on private gun sales, or any of the other gun control efforts he has made, so this is the alternative – change the rules.

The ATF also fails to note that most gun owners are in it for self-defense, not making a profit.
