SCOTUS Contradicted Itself With Midnight Ruling Against Trump Administration

The SCOTUS contradicted itself with a midnight ruling that at least temporarily halted the Trump administration’s deportations of Venezuelan illegals under the Alien Enemies Act (AEA). The challenge will be to obey it or ignore it. Justices Alito and Thomas dissented from the ruling.

The ruling stated:

“There is before the Court an application on behalf of a putative class of detainees seeking an injunction against their removal under the Alien Enemies Act. The matter is currently pending before the Fifth Circuit. Upon action by the Fifth Circuit, the Solicitor General is invited to file a response to the application before this Court as soon as possible. The Government is directed not to remove any member of the putative class of detainees from the United States until further order of this Court. See 28 U. S. C. §1651(a). Justice Thomas and Justice Alito dissent from the Court’s order. Statement from Justice Alito to follow.” (Reason)

The AEA is a law from 1798 that specifically allowed the government to restrict, detain and deport foreign nationals without court action.  The Trump administration views the huge influx of illegal immigrants as an invasion and seeks to deport them without any court action. SCOTUS halted the administration, but did not do it permanently, depending on the ruling from the Fifth Circuit Court. Its first ruling on deportations under the AEA allowed them to proceed-now it appears as if the SCOTUS contradicted itself.

In another recent ruling by Justice Kagan, she allowed deportations of Mexican nationals to proceed. What’s the difference? The logic of both escapes us. The four petitioners from the Mexican case were afraid of the cartels, and contained both males and families, not violent criminals. These Venezuelans are primarily violent criminals. The SCOTUS contradicted itself and the result is a confusing mess.

When SCOTUS finally issues a ruling, it will either be a win for America or a dangerous, dismal failure to protect our citizens.
