New York (and a few other states) had a quarantine rule that a NY Judge overturned as unenforceable. Rule 2.13 was used by Gov Hochul and the Health Commissioner during the Covid pandemic, and they renewed it every 90 days. The rule states that a person can be forceably quarantined and allowed the commissioner to order quarantining for anyone, anywhere, at any time…without regard for individual rights. It gave ALL power to the Commissioner.

Involuntary quarantine may have far-reaching consequences such as loss of income [or employment] and isolation from family.
The commissioner has unfettered discretion to issue a quarantine or isolation for anyone, even if there is no evidence that person is infected or a carrier of the disease. Further, the commissioner sets the terms, duration, and location of the detention, not an independent magistrate…
You can’t make laws or rules that don’t have protections built in to protect the citizens.”

The commissioner wanted to make Rule 2.13 permanent. Keep in mind that the New York Legislature never voted to have such a quarantine rule- this is strictly from the NY Health Commissioner. It appears as an attempt by New York leadership to continue the control over the populace.
Quarantine Rule 2:13 dumped just in time
It’s just in time for New York’s ‘next health emergency’: Gov Hochul just declared a Disaster Emergency over the outbreak of Monkeypox. The state so far has 1,345 confirmed cases of Monkeypox.

“After reviewing the latest data on the monkeypox outbreak in New York State, I am declaring a State Disaster Emergency to strengthen our aggressive ongoing efforts to confront this outbreak. More than one in four monkeypox cases in this country are in New York State, and we need to utilize every tool in our arsenal as we respond. It’s especially important to recognize the ways in which this outbreak is currently having a disproportionate impact on certain at-risk groups. That’s why my team and I are working around the clock to secure more vaccines, expand testing capacity and responsibly educate the public on how to stay safe during this outbreak.”

The declaration allows the state to acquire more vaccines, and mobilize more people who can give innoculations, such as EMS personnel, pharmacists and midwives. The state has a shipment of 110,000 vaccines coming to address the emergency. New York isn’t the only one: San Francisco Mayor London Breed also declared a state of emergency over Monkeypox.
At least this time around, New York will not be allowed to use quarantine rule 2.13. Unless they find a way around the court’s ruling, of course.
