Pennsylvania Court Rules Mail Ballot Law Unconstitutional

Even though mail ballots are thought by some experts to be more susceptible to fraud than in-person voting, their use was expanded vastly for the 2020 presidential election when states claimed that the COVID-19 pandemic required them to change their voting procedures.

But now a court has ruled that one of those changes, in Pennsylvania, was unconstitutional.

“Big news out of Pennsylvania,” President Donald Trump said on Friday, “Great patriotic spirit is developing at a level that nobody thought possible. Make America Great Again!”

A report from local Fox43 explained the Commonwealth Court in Pennsylvania agreed with challenges raised by Republicans to the changes made in advance of the 2020 election.

The ruling said Act 77, allowing Pennsylvania residents to vote by mail, violates Article VII, Section 1 of the Pennsylvania constitution.

Mary Hannah Leavitt, the Commonwealth Court president, said, “If presented to the people, a constitutional amendment to end Article VII, Section 1 requirement of in-person voting is likely to be adopted. But a constitutional amendment must be presented to the people and adopted into our fundamental law before legislation allowing no-excuse mail-in voting can be ‘placed upon our statute books.’”

Such changes were made arbitrarily in multiple states during the 2020 election process, raising questions about how elected state officials, or sometimes even bureaucrats, could simply change a state law or ignore it, during the election process.

It’s one of the factors Trump supporters have blamed for Joe Biden’s election last year. Others include the $420 million Mark Zuckerberg handed out to mostly leftist elections officials, outside of election campaign finance law, with instructions to recruit voters from Democrat areas, and the fact that both legacy and social media knowingly suppressed accurate – but damaging – reporting about the international financial maneuvers of the Biden family before the election.

Recent reports have suggested that China intelligence-linked interests turned over to the Biden family some $31 million in several deals, raising the prospect of the involvement of Joe Biden in transactions that surely could be considered to affect his national allegiance.

The Fox report explained an appeal is expected from Democrats, but it would throw “the state’s voting laws into doubt in a big election year.”

Act 77 simply approved mail-in voting by anyone for any reason. Previously, only those who qualified for absentee voting were allowed to mail their ballots.

In Pennsylvania, last November, some 2.6 million votes were cast in the presidential race by mail, the majority for Biden, who won the state by only 80,000 ballots.

Politico explained, “The ruling is the latest skirmish in a broader fight over mail voting happening in dozens of states. The practice once enjoyed broad bipartisan backing, but Republican support for the practice plummeted in 2020, as Trump attacked mail voting in the run-up to the election and then blamed it for his loss after, spreading conspiracy theories about widespread fraud within the practice. Since then, Republicans in battlegrounds and other states have sought to change voting rules via legislation or court challenges to restrict mail voting.”
