Illinois Governor Signs Bill HB 3751 Allowing Non-citizens to be Law Enforcement Officers

Some law enforcement groups are furious.

Illinois Governor JB Pritzker signed HB 3751 into law on July 28, as we previously reported. The bill allows legal permanent residents and DACA recipients whose deportation was deferred to become law enforcement officers in the state of Illinois. The Federal government requires applicants for Federal law enforcement positions to be citizens. Of course, Democrats could care less about the law, nor do they care about the consequences of their actions.

“Reinserts the provisions of the engrossed bill and adds that an individual against whom immigration action has been deferred by the U.S. Citizenship and Immigration Services under the federal Deferred Action for Childhood Arrivals (DACA) process is allowed to apply for the position of police officer, deputy sheriff, or special policeman, subject to specified requirements. Effective January 1, 2024.” Summary of the bill

DACA was declared illegal by a federal judge in 2021 and the program was closed. In October of the following year, an appellate court also declared it illegal. So, the basis of this law, the DACA program is illegal according to two court rulings. Now you have a snarl that will end up being hashed out in the courts. There are reportedly 30,000 DACA recipients in Illinois. Legal permanent residents that are able to obtain, carry, purchase, or otherwise possess a firearm under federal law are also allowed to apply.

One of the problems that this action could cause – a lack of trust in law enforcement – was addressed by the National Fraternal Order of Police.

One issue here may be missed: the US Military enlists non-citizens into its ranks. At one-point in history, certain military members were even granted citizenship at the end of their service, although that is no longer the case. It appears that Pritzker and the Democrats are hoping for the same outcome with this bill.

The sponsors of the bill claim that the goal is to help with police officer shortages across the state. This bill could, however, cause even more friction in communities. Some Illinois citizens are planning to take it to court if it isn’t repealed soon. It goes into effect January 1, 2024.
