On Tuesday, Breitbart and others reported that Rep. Pat Fallon, R-Tex., filed articles of impeachment against DHS Secretary Alejandro Mayorkas over his failure to secure the southern border.
“Since day one, Secretary Mayorkas’ policies have undermined law enforcement activities at our southern border. From perjuring himself before Congress about maintaining operational control of the border to the infamous ‘whip-gate’ slander against our border patrol agents, Secretary Mayorkas has proven time and time again that he is unfit to lead the Department of Homeland Security,” Fallon said in a statement to Fox News last week.
“His willful actions have eroded our immigration system, undermined border patrol morale, and jeopardized American national security. He has violated the law and it is time for him to go,” he added.

Fox News reported last week that Fallon’s one article of impeachment claimed that Mayorkas has failed to carry out the Secure the Fence Act of 2006. The law requires Mayorkas to maintain “operational control over the entire international land and maritime borders of the United States.”
The second article alleged Mayorkas “in violation of his constitutional oath, willfully provided perjurious, false, and misleading testimony to Congress.” The article cites Mayorkas’s testimony during two congressional hearings in which he claimed that the border was secure.
The third and final impeachment article claims that Mayorkas “publicly and falsely slandered” border agents who were accused of whipping Haitian migrants near the southern border.
“The 511-page report by the U.S. Customs and Border Protection’s Office of Personal Responsibility found ‘no evidence that [Border Patrol agents] involved in this incident struck, intentionally or otherwise, any migrant with their reins,’” Fallon wrote. “Secretary Mayorkas slandered his own Border Patrol agents and TXDPS Troopers involved in this incident, contributing to a further decrease in already-low morale among agents.”
This is not the first time we have heard talk of impeaching Mayorkas. In August 2021, Rep. Chip Roy, R-Tex., suggested impeaching him, along with Biden, over the mess at the border.
Last November, then-House Republican Leader Kevin McCarthy called on Mayorkas to either resign or face impeachment.
“Our country may never recover from Secretary Mayorkas’s dereliction of duty,” McCarthy stated. “This is why, today, I am calling on the Secretary to resign. He cannot and must not remain in that position.”
“If Secretary Mayorkas does not resign, House Republicans will investigate every order, every action, and every failure will determine whether we can begin [an] impeachment inquiry,” McCarthy added.
Breitbart reports the articles of impeachment have been filed with the House Judiciary Committee.
