17 GOP Lawmakers introduced a bill on Friday called “The Border Safety and Security Act of 2022.” Led by Rep Chip Roy (R-TX), it authorizes the Secretary of the Department of Homeland Security to stop the entry of illegal immigrants into the United States if he determines it necessary to maintain “operational control” of the Border. If he does not comply, the bill authorizes state Attorneys General to sue.
It would also require the suspension of entry of illegal immigrants if the DHS head cannot detain them as required in the Immigration and Nationality Act (INA). Should the DHS secretary not follow that requirement, it allows state attorneys general to bring legal action against the administration to enforce it.
The bill places the requirement to stop illegals from entering the US at the DISCRETION of the DHS Secretary. When the DHS Secretary is a left wing open border advocate like Mayorkas, it makes the entire bill problematic. “Require” is an iffy idea for the Biden Administration. Attorneys General have already sued the Biden administration over their ridiculous rollbacks of Trump’s border policies. Recently, 26 states signed on to a “Border Strike Force” in order to target the cartels that are bringing thousands of illegals and tons of drugs into the country since the Federal government refuses to do so.

At his discretion, the Secretary “may prohibit, in whole or in part, the entry of covered aliens at such border for such period of time as the Secretary determines is necessary…” The “may prohibit” part is likely to go nowhere. If Mayorkas refuses to comply with the bill, it authorizes states to take him to court for immediate ‘injunctive relief.’
As of mid-April there have been 44 multi-state lawsuits filed against the Biden Administration, with varying degrees of success and/or failure. The “gotaways” of persons not apprehended by the Border Patrol is into the thousands. Attempting to force Mayorkas to comply when he can’t even agree that he has no operational control over the border will not likely succeed. The Biden administration has flouted court rulings before, so there is no reason to believe they wouldn’t do that in this case as well.
The bill needs REAL teeth. A coalition of former Trump officials and GOP lawmakers is asking Republicans to unite behind a Border Security bill for the next Congress that would force the administration to turn away illegals at the border. Ladies and gentlemen, if there are no strong consequences for noncompliance, the crisis at the border will only continue.
