California Governor Gavin Newsom (who is not running for President but IS running for President) proposes a 28th amendment to the Constitution that he says will stop gun violence. Not only does it do nothing to “stop gun violence,” but it drastically infringes on the 2nd Amendment. It amounts to highly deceptive advertising.

First, adding a 28th amendment to the Constitution would require a Constitutional Convention. Then the Convention would have to vote to accept the amendment and that requires a 2/3 vote of all 50 states. Two-thirds of the states are not likely to vote to destroy the 2nd amendment. The narrative is nothing more than a ‘virtue signaling’ move to make himself look like he’s smarter than he really is.
The proposal has four points: Mandatory background checks (which are ALREADY in place under federal law), Raising the minimum age for gun purchase to 21 (no young people would be able to join the military right out of high school), instituting a three-day waiting period for gun purchases, and banning all assault weapons (which I’ll bet he can’t define). Newsom claims that the majority of Americans want what he’s pushing. In fact, only the uninformed ones do.
Will this presidential election be the most important in American history?
The Brady Bill that required background checks for all gun purchases in the United States was enacted in 1993. It’s a FEDERAL law and you can’t buy a firearm without going through the record check process, and yes, even at gun shows when buying from a dealer with an FFL. Either Newsom doesn’t understand that, or there is something else embedded in his deceptive advertising. We suspect he has enhanced background checks in mind, most of which are irrelevant to criminal or mentally ill mindsets. It takes ignorance to not comprehend that background checks have been around for decades.
He wants to raise the minimum age for purchasing a firearm to 21. The courts have said that it is unconstitutional to exclude 18–20-year-olds from the 2nd amendment, when they are considered fully adults and granted other Constitutional protections. Currently, young people can join the military right out of high school. That would come to a screeching halt if Newsom’s idea were adopted. He even stated in the video: “If they can’t buy a beer, they shouldn’t be able to buy a gun.” We have a recruiting problem – this would be the death-nell of a volunteer military.
Those waiting periods? A victim of domestic violence could easily die if barred for several days from purchasing a firearm for self-defense. Wait times are an infringement on the 2A, but liberals don’t care. Their narratives are extremely entrenched, and no one will tell them any different.
Then there’s his 28th amendment topper: banning “assault weapons.” Gavin Newsom has never been to war. He has never seen the difference between an automatic weapon (real “weapons of war” which are banned for most citizens already) and a gun that fires one bullet at a time and is commonly owned by millions of Americans. Courts have ruled that “commonly owned” weapons should not be banned. Not all “mass shootings” are committed by AR or AK style guns, either. But liberals think anyone who owns a gun is a criminal.
In the “Bearing Arms” newsletter, writer Tom Knighton, referring to recent Washington gun laws, stated that none of the laws passed have done anything to stop shootings.
These measures are always framed as being good for public safety, as reducing crime, and yet when everything shakes out, they don’t. They don’t do anything of the sort. At most, they make it harder for law-abiding citizens… to buy or own these kinds of firearms or magazines.
The criminals, unsurprisingly, just find a way around the law. It may inconvenience them, but not in any meaningful way. It doesn’t stop them. It doesn’t even challenge them much in figuring out how to circumvent the law. Tom Knighton, Bearing Arms
Liberal narratives are always deceptive, and this idea for a “28th amendment” is no different. It’s politically motivated and has no basis in reality. If libs really want to “stop these massacres” they will need to find other avenues for prevention instead of just focusing on the hardware.
