Verdict in Trump Civil Case: Not Guilty of Rape, but Liable for Sexual Abuse, Defamation

$5 Million in damages awarded

The verdict in the civil case against Donald J. Trump involving E. Jean Carroll was reached only 3 hours after deliberations began. The jury said they couldn’t prove beyond a reasonable doubt that he raped her. They did find him liable for sexual battery and defamation.

The jury awarded Carroll a total of $5 million in the lawsuit. Jury members found that Trump did not rape Carroll but sexually abused her, and awarded damages of $2 million in compensatory damages and $20,000 in punitive damages for battery.

The jury awarded $1 million in damages, $1.7 million for reputation repair, and $280,000 in punitive damages, for defamation.

Carroll, a former columnist for ELLE Magazine, alleged that she casually ran into Trump at a Bergdorf Goodman store. She claimed that he asked her to help him pick out some lingerie for a gift, and that they were both laughing over the situation. She then stated that he led her to a dressing room, pushed her inside, slammed her head into the wall and proceeded to sexually accost her. Keep in mind that none of these allegations were raised at the time, and she had difficulty pinning down the time frame, although said it was “sometime around 1996.” She also claimed to have known him since 1987. He denies it.

Witnesses for Carroll stated that she did tell them about the incident closer to the time of occurrence. Take note that no police report was filed. The Defense called no witnesses during the trial. A deposition by Donald Trump stated that he did not do it. But his own comments against the proceeding and the Plaintiff likely damaged his case.

Will this presidential election be the most important in American history?

The verdict in this case will set a dangerous precedent for Donald Trump.  Dozens of other women have alleged sexual conduct by the former President.  Are their claims real? Or are they manufactured stories aimed at destroying Donald J. Trump from running for President again? As this was a civil case and not a criminal one, it will not preclude him from running.

Trump will likely appeal this case. He has been under constant attack for everything from his business practices to his private life since he decided to run for the nation’s highest office in 2015.
