Suspect in LASD Police Recruit Injuries Released from Custody.

"Initial Complaint Not Good Enough to Charge"

Even with a video showing the suspect, Nicholas Gutierrez plowing an SUV through a group of LASD police recruits, police released him from custody saying that the initial complaint wasn’t good enough to charge him. But there were some hiccups in the charging criteria according to LA County Sheriff Villanueva at LASD.

Nicholas Gutierrez, 22, was held on suspicion of attempted murder of a peace officer on a $2 million bond for driving his SUV into 25 cadets, leaving more than dozen injured and at least five in critical condition.

Authorities later provisionally released Gutierrez “until we can have the case iron clad, iron proof, and submitted to the DA for filing consideration,” Los Angeles County Sheriff Alex Villanueva told News Nation.

Villanueva also said that investigators went through an interview process with all parties involved in the incident and examined video surveillance and other physical evidence. He said that investigators had enough evidence to come to the conclusion that the crash was intentional.

“They were able to form the opinion that this was a deliberate act,” Villanueva said. “That is the conclusion we’ve arrived [at].” Daily Wire

OK so even after reviewing the video, and investigating to conclude the assault might be intentional, the suspect was released.

Of course this IS California.

Gutierrez reportedly had marijuana in the car, and passed a field sobriety test, ultimately having no alcohol in his blood. He was initially charged with attempted murder of police officers. But the law requires that the prosecutor prove that the crash was “intentional” and that’s where the narrative breaks down.

The SUV struck around 25 of the LASD police recruits, leaving many of them with extremely serious injuries. From broken bones to “loss of limb,” brain swelling and other injuries, the recruits will have a long recovery ahead of them. A few of them with lesser injuries were released to go home. It is unclear at this time whether there will be financial compensation for them from this terrible accident.
