Chief Justice John Roberts joined with the 4 liberals and ruled against the President’s asylum policy. Does the ruling have something to do with the recent spat between the President and Chief Justice? No, actually, it has to do with US law regarding asylum claims, according to the Washington Times. And the Supreme Court’s ruling wasn’t the only bad news coming out of the courts this last week.
The Supreme Court ruled that while other legal challenges were going through the courts, the lower court injunction against the asylum ban would be upheld. Meanwhile on Thursday, the Trump administration released a “deal” with Mexico that would hold asylum seekers in Mexico while their claims are going through the courts. Attorneys have vowed to sue over that rule as well.
What did the ban do?
The ban signed by President Trump was designed to keep asylum seekers only at sanctioned ports of entry. Any of them who came through the border at other locations would be deported. But US law requires that all claims of asylum must be accepted regardless of where they came through. The best solution? Change the law, which is out of reach now that the Dems have control of the House.
“Any alien who is physically present in the United States or who arrives in the United States (whether or not at a designated port of arrival and including an alien who is brought to the United States after having been interdicted in international or United States waters), irrespective of such alien’s status, may apply for asylum in accordance with this section or, where applicable, section 1225(b) of this title.” Title 8,US Code § 1158
A Federal judge also ruled last week that all asylum seekers who had been deported must be returned to the United States. Title 8 is why the judge ruled it. Trying to stem the tide of migrants flowing into the United States has been a huge nightmare for the Trump administration.
The law regarding asylum was not created for thousands of migrants descending on the United States all at once. It was designed as a protection only for those who are experiencing persecution based on “race, religion, nationality, membership in a particular social group, or political opinion.”
It was not created for job seekers. It was not created to enable liberals to deluge the borders of the United States with illegals just so they could get more Democrat votes. A wall would force them to go to the sanctioned ports of entry.
