Sen Marco Rubio Asks AG Barr to Look into John Kerry Meetings With Iran

As we previously reported, former Secretary of State John Kerry met with Iranian officials on several occasions in an effort to save his “Iran deal.” But now, Senator Marco Rubio is trying once again to have him investigated for those meetings – because they may have been in violation of FARA and/or the Logan Act.

Senator Rubio wrote a letter previously to AG Sessions to request an investigation, but his request went nowhere. This letter to AG William Barr read, in part:

“I write to make you aware of a September 18, 2018 letter I sent to your predecessor regarding potential violations of the Logan Act (18 U.S.C. § 953) and the Foreign Agents Registration Act (22 U.S.C. § 611 et seq.) by former Secretary of State John F. Kerry.  As you know, former Secretary Kerry’s actions since leaving office have come under scrutiny as they related to the Iran nuclear deal, known formally as the Joint Comprehensive Plan of Action (JCPOA).

The full letter to your predecessor is attached.

The American people deserve to know that U.S. laws are enforced regardless of any individual’s past position. The Department of Justice should therefore make a determination on whether or not former Secretary of State John F. Kerry’s recent actions related to the Joint Comprehensive Plan of Action with Iran potentially violate the Logan Act or the Foreign Agents Registration Act.

Even though prosecution of the Logan Act has been rare, when the actions of a former official definitively work against the sitting President, it’s time to re-evaluate whether prosecution should occur.

The Logan Act was created in 1799 by the US Congress. It criminalized actions by persons who negotiated with foreign governments when they were not authorized to do so. John Kerry fits that bill and always has – he was accused of colluding with North Vietnam during the Vietnam War.

FARA, or the Foreign Agents Registration Act,
“requires persons acting as agents of foreign principals in a political or quasi-political capacity to make periodic public disclosure of their relationship with the foreign principal, as well as activities, receipts and disbursements in support of those activities.”

The Free Beacon reported,

In his letter to Barr, Rubio included his previous letter to Sessions, sent in September of 2018, which highlighted Secretary Kerry’s admission that he had met with Iranian foreign minister Javad Zarif “probably three or four times,” since the end of the Obama administration. The Boston Globe reported last May that Kerry had been “quietly seeking to salvage Iran deal he helped craft” and described Kerry has engaging “in some unusual shadow diplomacy,” with Zarif.

FARA was used extensively by the Mueller Investigation for targeting members of the Trump team. Maybe it’s about time the real culprits get a taste of their own medicine.
