SB 215: Ohio Gov Signs Constitutional Carry – That Makes 23 States

Ohio Gov Mike DeWine signed SB 215 into law on Monday, making Ohio the 23rd state to pass Constitutional Carry. Whether he was actually happy about doing it is another matter, but at least his state now has the benefit of not having to obtain a permit to carry a gun concealed. The bill goes into effect on June 12, 2022.

SB 215 says the motorists will not have to inform a police officer that they have a gun concealed in their vehicle unless the officer asks. Anyone 21 or older also no longer has to take a class to be able to carry. Always remember: you must pass a background check to purchase a firearm anyway, so having to obtain one to carry a firearm is redundant. We suspect that some people will opt to obtain a permit anyway if they want to venture outside the state with their weapon.

Senate Bill 215, which takes effect in 90 days, allows anyone 21 or older to carry a concealed firearm unless state or federal law prohibits them from possessing a gun. Ohio will become the 23rd state to allow conceal-carry in public without needing a license, according to the National Rifle Association’s Institute for Legislative Action. Ohio currently requires conceal-carry applicants to take eight hours of training and pass a background check…

SB215 will also no longer require motorists to proactively tell law enforcement about concealed handguns in their vehicles during traffic stops, though drivers would still have to truthfully say whether they have a gun with them if an officer asks.

Right now, drivers who fail to pre-emptively notify an officer in Ohio that they have a gun with them face a first-degree misdemeanor, punishable by up to six months in jail, a $1,000 fine and suspension of their concealed-handgun license. SB215 eliminates that penalty.

Ohio Gov DeWine (R) has made conflicting statements about permitless carry over the years, particularly after a shooting in Dayton in 2019 that left nine dead. Did he want to sign SB 215? Probably not, but it was backed by Republicans and the NRA, so it pushed him into a corner. He had already promised that he would sign a permitless carry bill prior to that mass shooting. He was also hesitant to sign a change to Ohio’s stand your ground bill that removed the “Duty to retreat” section. But to his credit, he did it anyway.

The Left constantly claims these bills will endanger both law enforcement and citizens. The statistics never bear that out. Now Ohio will join the 22 other states embracing Constitutional Carry.
