A lawyer is claiming his client — a Muslim immigrant — is innocent because he didn’t know that forcing someone to have sex against their will is rape. Andreas Welin, the lawyer for Emil Khodagholi, an immigrant convicted earlier this year, says that he will take his case all the way to the Swedish Supreme Court because the law against rape isn’t well defined.
His client filmed the assault, which was live streamed on the Internet.

According to Welin, the case will try to raise “several questions about what actually constitutes an offence, which criteria must be considered to obligate someone to reveal rape.”
Khodagholi has received Swedish citizenship and the other two immigrants will not be deported even though they were convicted of rape.
Sweden is currently the rape capitol of Europe. Twenty years ago they had one of the lowest rape rates in the world. A big part of the reason rape is so prevalent is because of the large number of Muslim refugees they allowed into their country and the fact that only one in five rapists are deported from the country, as the UK Daily Mail reported back in March:
The stand-out statistics from between 2010 and 2014 are:
- 19 percent of foreign nationals registered as Swedish residents convicted of rape were deported
- 19 percent of foreign nationals registered as Swedish residents convicted of aggravated rape were deported
- 13 percent of foreign nationals registered as Swedish residents convicted of child rape were deported
- 17 percent of foreign nationals registered as Swedish residents convicted of aggravated rape of a child were deported
The number of deportees increased when it came to foreign nationals who had not been registered as Swedish residents.
In rape cases, 63 percent of those found guilty were extradited and 73 percent in aggravated rape cases.
When it came to child rape, a shocking 48 percent of those found guilty and not registered as Swedish residents were allowed to stay in Sweden.
Sweden, it seems, is a great country if you are a Muslim immigrant but not so great if you are a Swedish woman.
After the arrest, another young woman came forward, telling Swedish media that she had also been a victim of sexual assault perpetrated by one of the men who she recognised in the video. The 21-year-old Swedish woman said that she had been raped 15 months before the livestream incident while taking a shower in her apartment.
The trio was put on trial earlier this year and received prison sentences between six months and two years, four months. The two men directly involved in the rape are asylum seekers, while Mr Khodagholi is an Iranian migrant who has been granted Swedish citizenship.
The prosecutor in the case decided not to pursue deportation in the case of the two asylum seekers, who had both come to Sweden as unaccompanied minors. Defence lawyer Stefan Wallin claimed such actions would have violated the Swedish Aliens Act.
