Gun rights victory protects ‘2A Sanctuary’ in Columbia County, OR

Oregon gun rights activists are celebrating a court victory in that state’s Columbia County that left in place a pair of gun rights measures designating the county a “Second Amendment Sanctuary,” preventing the county from enforcing “most state and federal gun control measures,” as noted by Fox News.

In a prepared statement, the Oregon Firearms Federation declared, “This is a victory with national implications and a repudiation to the politics of division that (Michael) Bloomberg and the gun grabbers are so famous for.”

“Today the Columbia County Court shot down “Everytown For Gun Safety”,  Mike Bloomberg’s New York Lawyers, and the usual gaggle of state worshippers and upheld the County’s 2nd Amendment Sanctuary ordinance, an ordinance the county commissioners hoped to torpedo,” OFF said.

The group was supported by Gun Owners of America, a Virginia-based national gun rights organization. And the Gun Owners Foundation. In a separate joint news release, those organizations stated, “In an effort to undo the will of their constituents and attack the right to keep and bear arms, the Columbia Board of County Commissioners — with support from Everytown for Gun Safety — sought a court review of the citizen-passed SASO.”

In his decision to dismiss, Circuit Court Judge Ted Grove wrote, “While a governing body may seek review of an ordinance, even one that incorporates initiative measures, judicial examination still requires a justiciable controversy.

“Petitioners do not seek to defend their ordinance from a challenge or resolve some conflict between parties,” the judge observed. “Instead, Petitioners seek what amounts to an advisory opinion designed to invalidate their own newly passed ordinance.

“Petitioners do not have authority to seek, and the court does not have authority to grant, review of an ordinance without a justiciable controversy,” he concluded.

The two ordinances were passed by voters in the county, which is located along the lower Columbia River northwest from Portland. They were the Second Amendment Sanctuary Ordinance and Second Amendment Preservation Ordinance.

Oregon gun rights have been under constant attack by the Democrat majority in the State Legislature. Democrat Gov. Kate Brown is also an ardent anti-gunner.
