In a no surprise ruling, the DC Appeals Court stated that President Trump does not have immunity from prosecution regarding the Jan 6th case. Special prosecutor Jack Smith is deliriously happy. This unanimous ruling is not unexpected, as the DC Appeals Court has been biased from the get-go against Trump. The ruling will be appealed to the Supreme Court if they choose to take it.
Fact: Jan 6th, 2021, was 13 days prior to the transition to a new president on January 20. Until that date, Donald Trump was supposed to be still in charge of the country. The DC Appeals Court apparently ignored that fact in favor of allowing the prosecution to continue. It also sets a dangerous precedent for political persecution of presidents as they leave office: if this ruling stands after the Supreme Court, political opponents will be poised to prosecute rivals with impunity.
“We have balanced former President Trump’s asserted interests in executive immunity against the vital public interests that favor allowing this prosecution to proceed… We conclude that ‘[c]oncerns of public policy, especially as illuminated by our history and the structure of our government’ compel the rejection of his claim of immunity in this case…For the purpose of this criminal case, former President Trump has become citizen Trump, with all of the defenses of any other criminal defendant. But any executive immunity that may have protected him while he served as President no longer protects him against this prosecution.” DC Appeals Court (The Epoch Times)
The DC Court of Appeals very own statement acknowledges that there is such a thing as executive immunity. The problem is that they ignore that immunity lasting the full length of a president’s term. They haven’t ‘balanced’ anything.
The argument by the prosecution that Donald Trump would hire SEAL Team Six to take out his political opponents is laughable. They have been watching too much TV. But the court obviously took that to heart in order to allow this kangaroo prosecution to continue. That fact that President Trump specifically told his supporters to go to the Capitol peacefully has been completely ignored, as have the revelations about agitators within the crowd. The riot (not an insurrection) was a setup from the beginning. Have you ever heard of an insurrection being done by unarmed people with a flag on a stick and a cell phone? Me neither.

President Trump responded on Truth Social:
A President of the United States must have Full Immunity in order to properly function and do what has to be done for the good of our Country. A Nation-destroying ruling like this cannot be allowed to stand. If not overturned, as it should be, this decision would terribly injure not only the Presidency, but the Life, Breath, and Success of our Country. A President will be afraid to act for fear of the opposite Party’s Vicious Retribution after leaving Office. I know from personal experience because I am going through it right now. It will become a Political Weapon used for Election Interference. Even our Elections will be corrupted and under siege. So bad, and so dangerous for our Nation. SAVE PRESIDENTIAL IMMUNITY! Another problem with this ruling is the optics: Some voters who are uninformed may see this as a reason to not back President Trump – that would be a mistake. The DC Appeals Court is part of the DC Swamp – they hate him.
