While gun rights organizations are blasting Joe Biden for his renewed attack on so-called “ghost guns” and his nomination of another gun ban proponent to head the federal Bureau of Alcohol, Tobacco, Firearms and Explosives, New York Attorney General Letitia James is cheering.
Biden announced his new attack on home gunsmiths during an early afternoon announcement at the White House.
In a press release, James declared, “Dangerous ghost guns exist for only one purpose — to put guns into the hands of those who are legally prohibited from owning a firearm. In New York, we have taken significant action to crack down on gun violence, taking more than 2,700 guns off our streets and shutting down websites that sell ghost guns in New York. But our efforts can only go so far if these untraceable weapons are not effectively regulated at the federal level. Ghost guns are just as dangerous as traditional firearms, and with the nomination of Steve Dettelbach to serve as director of the ATF, Americans can feel confident in the federal government’s commitment to gun safety. I thank President Biden for his unwavering dedication to this issue, and I look forward to working with him to keep our communities safe.”

But according to CBS News, “In New York City in 2019, we recovered 47 ghost guns. In 2020, we recovered 150 ghost guns. In 2021, that number jumped up to 375. And so far in 2022, we have 85 compared to 20 last year,’ NYPD Chief of Intelligence Tom Galati said last month. ‘That’s a 325% increase of seizures of ghost guns since last year.’”
“But ghost guns are used in only a fraction of gun crimes,” CBS added. “About 12% of guns seized by the NYPD so far this year were ghost guns, according to the New York Post, although data is limited because of how difficult it is to trace them.”
Biden once again claimed the firearms industry is immune from lawsuit, which has already been debunked.
According to an announcement from the White House prior to Biden’s Rose Garden speech, “Today, the President and Deputy Attorney General will also announce that the U.S. Department of Justice has issued a final rule to rein in the proliferation of “ghost guns” – unserialized, privately-made firearms that law enforcement are increasingly recovering at crime scenes in cities across the country. Last year alone, there were approximately 20,000 suspected ghost guns reported to ATF as having been recovered by law enforcement in criminal investigations – a ten-fold increase from 2016.[1] Because ghost guns lack the serial numbers marked on other firearms, law enforcement has an exceedingly difficult time tracing a ghost gun found at a crime scene back to an individual purchaser.
“This final rule bans the business of manufacturing the most accessible ghost guns, such as unserialized ‘buy build shoot’ kits that individuals can buy online or at a store without a background check and can readily assemble into a working firearm in as little as 30 minutes with equipment they have at home. This rule clarifies that these kits qualify as “firearms” under the Gun Control Act, and that commercial manufacturers of such kits must therefore become licensed and include serial numbers on the kits’ frame or receiver, and commercial sellers of these kits must become federally licensed and run background checks prior to a sale – just like they have to do with other commercially-made firearms.”
Completing his remarks about guns, Biden insisted he supports the Second Amendment. He then repeated a statement that has been roundly debunked as a canard even by the Washington Post Fact Checker.
“From the very beginning, the Second Amendment didn’t say you could own any gun you want and big as you want,” Biden falsely asserted. “You couldn’t buy a cannon when in fact the Second Amendment passed. And certain people from the very beginning weren’t allowed to purchase guns.”
