A.G. nominee Garland says DOJ will ‘advance’ Biden’s gun control policies

Fox News is reporting that Attorney General nominee Merrick Garland “signaled Monday that the Justice Department under his leadership would “advance” the policies of the Biden administration on gun control.

According to the report, Garland was responding to a question from Sen. Mike Lee (R-Utah) about whether the nominee would support “banning certain types of firearms?”

“Well, as I’m sure you know,” Garland responded, “the president is a strong supporter of gun control and has been an advocate all his professional life on this question.”

“The role of the Justice Department,” he added, “is to advance the policy program of the administration as long as it is consistent with the law.”

Will this presidential election be the most important in American history?

What about it being consistent with the Constitution, grassroots activists might wonder.

Biden’s attitude about firearms is well-known and documented. As noted by the Fox News story, Biden’s plan for gun control says, “Joe Biden will enact legislation to once again ban assault weapons … will enact universal background check legislation, requiring a background check for all gun sales … and buy back the assault weapons and high-capacity magazines already in our communities.”

Several days ago, Ammoland News—which covers gun-related news of all kinds—reported on Biden’s pronouncement on gun control on the anniversary of the 2018 mass shooting at Marjory Stoneman Douglas High School in Parkland, Fla.

As noted by Ammoland, Biden’s agenda, which gun rights advocates including Alan Gottlieb at the Citizens Committee for the Right to Keep and Bear Arms calls “extreme,” includes these tenets:

  • Licensing for citizens before they can purchase a firearm.
  • Universal background checks.
  • A ban on modern sporting rifles and original capacity magazines.
  • “Smart gun” technology
  • Repeal of legal protection for firearms makers from harassment lawsuits designed to bankrupt the firearms industry.
  • One-gun-per-month restrictions for law-abiding gun owners.
  • Mandated “safe storage” of firearms.
  • Penalize adults for allowing minors access to firearms.
  • Expand so-called “red flag” laws.
  • Extend the background check period from three to at least ten days.

These can be found in Biden’s gun control scheme, which has been available online for at least a year. It would be incredulous for anyone to plead ignorance of Biden’s agenda.

“Where there is room under the law for the president’s policies to be pursued, I think the president is entitled to pursue them,” Garland told the Senate Judiciary Committee Monday.

But the question remains, where is there room under the Constitution for Biden’s policies? Perhaps if the Supreme Court takes a Second Amendment case, the nation will find out.
