NY deputies seize Navy vet and retired, decorated cop’s firearms
Undoubtedly, there are some who still cling to the idea that guns can’t be confiscated in America. Gun confiscation can and is happening in our nation. Listen people, the anti-gunners are working overtime to take away your Second Amendment rights.
If the headline of this article doesn’t convince you, then perhaps nothing will. There is a war on to take away your Contsitutional rights. The right to bear arms is something that our founding fathers established upon our nation’s framing. However, we have to stand up for our rights or watch them continue to evaporate.
Early last year, in January actually, I wrote about how the Obama administration was trying to take away our guns. In the article titled, “Obama looks to revoke gun rights for seeing a shrink; I outlined how his administration was hell-bent on trying to revoke the Second Amendment in America.
In that article, it was stated: “Critics of the Obama administration warned us this was coming, and now it’s here. Obama told Americans he intended to fundamentally transform America, and that’s what he’s doing. His “much-feared expansion” of taking gun rights away from law-abiding citizens is upon us. Through the use of mental health diagnosis, he’s cracking down on gun ownership.”
In May of last year what critics of Obama said about gun control happened to Donald Montgomery, a NY cop for 30 years and a Navy veteran. He went to a Long Island hospital complaining of insomnia. The doctors discharged him with a diagnosis of “depression and insomnia.” A short time later, he returned to the hospital and stayed for 48-hours. The problem came after the hospital where he stayed erroneously reported him as an “involuntary admission,” triggering the SAFE Act reporting provision.
Under the SAFE Act those catogerized as a risk for owning guns by mental health professionals have their names entered into a database. After people are deemed unfit to own a firearm the SAFE Act is triggered, and gun owners have their firearms confiscated.
The SAFE Act became law with little public debate after the mass shooting at Sandy Hook. The law went into effect with little public debate after Gov. Andrew Cuomo convinced NY legislators something needed to be done about gun control. Because Montgomery was deemed unstable by the hospital staff after his hospital stay; Suffolk County deputies showed up on his doorstep to seize his firearms on May 20.
In total four firearms were confiscated, a Colt .38 handgun, a Derringer .38, a Glock 26 9-mm. and a Smith & Wesson Bodyguard 380. On Dec. 17, Montgomery filed a lawsuit in Rochester Federal Court.
The lawsuit Montgomery filed “contends that Gov. Andrew Cuomo and other state officials violated his Second Amendment rights when his guns were seized after a brief hospital stay for insomnia,” according to Fox News. The suit also claims a psychiatrist at the hospital told him, “You don’t belong here” and “I don’t know why you were referred here.”
Montgomery is insisting in his lawsuit that the state of NY issue written notifications to every person who has been put into the SAFE Act’s database. The Fox News report also says the “Syracuse Post-Standard found nearly 39,000 names in the database and that 278 of those were gun owners who were in danger of losing their firearms. The list included 16 in Suffolk, where Montgomery lived.”
This writer agrees that those who are a danger to themselves and others around them shouldn’t own guns. It should take more then one mental health professional or hospital to take away someone’s firearms. Health professionals often make mistakes, that’s why hundreds of thousands of people die each year in hospitals, for example.
However, immediately seizing firearms is our government’s intention. What leads one to believe the intention of our government is bent on taking away our Second Amendment rights you might ask? Well if the subject of this article doesn’t speak volumes about their intent then listen to what one U.S. Justice foundation lawyer Michael Connelly has said.
Connelly said,
military veterans are still the primary target, the ultimate goal is the disarming of all Americans. This mirrors the actions of the Nazi party in Germany and other dictatorships that have used alleged mental illness to disarm, imprison, and control their populations.
