Court orders Virginia school to let girl use boy’s bathroom

Welcome to Obama’s America where bathrooms aren’t even safe.  On Friday, the Daily Caller reported that a federal court ordered the Gloucester County School Board in Virginia to let a girl use the boy’s bathroom while his/her lawsuit is working its way through the court system.

According to the Daily Caller:

U.S. District Judge Robert G. Doumar told the Gloucester School County Board that Gavin Grimm, who was born female but transitioned to male, must be able to use the bathroom that he wants while his lawsuit is working its way through the courts, reports the Daily Press.

“I am elated to hear that I’ll be able to attend my senior year of high school with my full rights restored. After nearly two years of humiliation and intense struggle, equality has finally prevailed. Now hopefully other transgender people will not have to face this type of discrimination,” Grimm said in a statement.

The Daily Press said the school board plans to appeal the case to the U.S. Supreme Court, where, Peter Dujardin added, “it could set the law for the nation on how U.S. law barring discrimination on the basis of sex applies to transgender individuals.”

Or more importantly, who can use which bathrooms in our schools.

Last September, Dujardin said, Doumar denied Grimm’s request for an injunction, citing, in part, the privacy of other students in the school.  But the Fourth U.S. Court of Appeals overturned that ruling in April, saying the policy forbidding Grimm from using the boy’s restroom was discriminatory.

“The School Board understands the implications of the order and will continue to defend its reasonable and nondiscriminatory solution to this issue at the Supreme Court and trial court levels,” the board said in a statement.

Naturally, the Obama DOJ filed a brief agreeing with Grimm and the ACLU.  The judge’s order only applies to the restroom, not the boy’s locker room or any other facility.
